Chinese subjects shall not be prevented from entering the said areas for the purpose of hunting or for the collection of ginseng roots. The Chinese authority shall be at liberty to dispose of to Chinese subjects, for agricultural purposes, any tillable land that may be found within the said timber areas, and the said Company shall not exercise any interference. The inhabitants of the said timber areas may procure therefrom such timber as is used for building material and fuel, but this must be made known to the said Company through the Deputy residing on the areas, who will designate the locality, make an estimate of the quantity of timber, and issue a special certificate; but the wood thus procured must not be sold to a third party. If any pasturage is found within the said areas, the said Company may breed cattle thereon, and procure therefrom hay for sheep and goats. One Kopeck shall be paid to the Chinese Government Treasury for each pood of hay.
Art. 7. The said Company shall procure such timber from the said areas as are stated in the licence. Four-tenths of a kopeck shall be paid for each arshen (28 English inches) length and 1 vershook (1½ English inches) in thickness; this applies to lumber 16 inches (Russian inch same as English inch), Russian measure in diameter and 12 feet Russian measure in length only; any size exceeding this, half a kopeck shall be paid for each arshen length and 1 vershook in thickness of wood. One rouble shall be paid for every cubit sagen (1 sagen equals 7 English feet) of wood used for fuel. Three and a-half kopecks shall be paid for each piece of track wood (7 sleeper). The diameter of any lumber of large size shall be measured by the smaller end. Any fraction more than six-tenths of an inch shall be considered as 1 inch. As to lengths, such size as reaches one-fourth of a foot shall be taken into account. This tariff shall continue in force for five years after the date on which this Agreement is signed. After the expiration of that period the licence question shall be taken up for reconsideration. If the said Company shall purchase any lumber from merchants who received their permission from the Chinese authorities, the said Company shall pay licence fees, according to the tariff of this article, upon receiving the consignment of lumber.
Art. 8. The Chinese authority shall appoint Deputies to reside in the areas stated above, who will, in conjunction with the Russian officers, keep records of the varieties, sizes, and quantities of lumber procured from the said areas for the purpose of calculating the licence fee.
Art. 9. For every shong (6 acres) of Government land, without reference to the quality, if the land that may be occupied for the building of dwelling-houses, the storage of lumber, and the establishment of factories at the junction of roads, the said Company shall pay 3 roubles annually as rental. If it be private land, an annual rent shall be agreed upon with the owner.
Art. 10. As the forests are subject to the preservation measures of the Chinese Government, the privilege of felling timber granted to the said Railway Company shall not interfere with any regulations that may be promulgated by the Government for the preservation of forests.
Art. 11. According to the present condition of the railway in Kirin Province, 20,000 cubic sagen of wood are consumed annually as fuel, 80,000 pieces of track wood, and 20,000 pieces of timber of considerable size. If in future the railway prospers and consumes or requires more wood than the present estimates, the Chinese authorities may grant more.
Art. 12. The said Railway Company may sell its superfluous wood, but tax must be paid according to the prevailing tariff.
Art. 13. After this Agreement is ratified it shall be binding on both parties. All previous Agreements and licences shall be superseded.
Art. 14. This Agreement shall be drawn up in Russian and Chinese, two copies of which shall be made, with charts of the timber areas appended, which will be sealed and signed. One copy shall be deposited in the yamen of the Governor of Kirin, another copy delivered to the Eastern Chinese Railway Company. In the event of controversy the Chinese text shall be deemed authoritative.

INFORMATION has reached us to the effect that basis for loan of £7,000,000 for redemption of railway from Peking to Hankow has been agreed on by British and French groups, and that their representatives in China have been instructed accordingly. Germans prefer to take no part in the transaction. Mr. Hillier will furnish you with details.
Chinese Government will be informed by French Minister that quotation for any redemption loan will be refused unless they accept proposed basis or continue present contract.
